Allegedly, the theft involving the firearm stems from a gun on consignment at Wortham Firearms that was not returned to its owner after the shop closed in late 2011.
Wortham was previously indicted for theft greater than or equal to $1,500 and less than $20,000 by a Kaufman County grand jury in November for which there is an outstanding warrant, according to Kaufman County records. This case is set for an announcement in the 86th District Court on January 2, 2014. A conviction on this indictment is also a state jail felony.
Wortham Firearms is most remembered for their location on US Highway 80 before it was destroyed in a fire involving Philbecks antiques in 2009. In 2011, Wortham Firearms was located across the highway and encountered would-be burglars who attempted to gain access to the store through the front door but failed.
According to the Bureau of Alcohol, Tobacco, Firearms and Explosives records, Wortham Firearms later moved to 307 East Broad Street, Forney, Texas. Wortham Firearms went out of business in late 2011.
