KAUFMAN COUNTY, Texas – It's been more than two years since off-duty Dallas County Constable Guy Farley was killed in a head-on collision on Farm-to-Market (FM) 741. After several agreed resets and continuances, jury selection and a jury trial are scheduled to begin on Monday, August 4, 2014, for the Kaufman County man accused of the June 9, 2012, intoxication manslaughter death of Farley.

34-year-old Warren Ray Patton Jr. is facing a charge of intoxication manslaughter with a vehicle and an additional manslaughter charge, both second-degree felonies. Patton allegedly drove his BMW across the center line of FM 741 near U.S. Highway 175 and struck off-duty Officer Guy Farley's Chevy Silverado head-on – which resulted in Farley's death.
Any rulings impacting blood and urine test results will be discussed Monday, stated Kaufman County 422nd District Court Judge B. Michael Chitty.
Defense Attorney Brandi Fernandez requested any ”underlying data” related to the blood and urine tests taken at the hospital, if they exist.
A “gatekeeping” hearing, under Rule 702 of the Federal Rules of Evidence, may conducted to hear expert testimony from both parties pertaining to the blood and urine tests prior to any evidence being presented to the jury to determine the reliability of the tests and sound methodology.
The jury selection process is scheduled for 9 a.m. Monday, August 4, 2014. The jury trial is also scheduled for the same day depending on the amount of time taken for jury selection.
