KAUFMAN COUNTY, Texas – The man awaiting trial in the intoxicated manslaughter with a vehicle death of off-duty Dallas County Constable Guy Farley in 2012 is now behind bars for aggravated assault with a deadly weapon stemming from a case filed by the Crandall Police Department.

34-year-old Warren Ray Patton Jr. was arrested for the aggravated assault charge yesterday at the Kaufman County Courthouse while at a hearing on the intoxicated manslaughter charge. An arrest warrant was previously issued for Patton for the aggravated assault with a deadly weapon charge on May 13, 2014, before his hearing.
The Kaufman County Sheriff's office took Patton into custody and later booked him into the Kaufman County Jail on a $175,000 bond. Patton's bond in the intoxicated manslaughter case was also held insufficient with a new bond set in the amount of $100,000.
Prosecutors previously said Patton had a blood alcohol level of .086 which was drawn at Parkland Hospital following the fatal accident that killed Farley on June 9, 2012. Patton allegedly drove his BMW across the center line of Farm-to-Market (FM) 741 near U.S. Highway 175 and struck Farley's Chevy Silverado head-on.
Farley was pronounced dead at the scene and Patton was taken to Parkland Hospital with non-life threatening injuries. Prosecutors allege alcohol and other drugs played a role in the accident, including evidence of hydrocodone, Xanax, diazepam, and nordiazepam.
Taryn Davis, who is representing Patton, filed a motion to suppress the blood alcohol test results in February stating they were obtained without consent or a valid search warrant. The motion is still pending in the 422nd District Court.
According to court documents, a jury announcement for the intoxication manslaughter charge is scheduled for May 15, 2014, with jury trial on May 19, 2014. However, a motion for continuance was filed yesterday. It is unknown at the time of reporting if the motion for continuance was granted.
