Aggravated assault charge to be dismissed for man awaiting intoxicated manslaughter trial
CRANDALL, Texas – An aggravated assault charge filed against the man awaiting trial for the intoxicated manslaughter with a vehicle death of an off-duty Dallas County constable will soon be dropped, according to the Crandall Police Department.

34-year-old Warren Ray Patton was arrested and jailed on the aggravated assault charge on May 13, 2014, while at a court hearing on the intoxicated manslaughter charge.

According to the Crandall Police Department, on May 12, 2014, the Crandall Police Department responded to an aggravated assault call in the 400 block of North Main Street in Crandall, Texas. 27-year-old Raymond Chapman, the alleged victim of the aggravated assault, told police that Patton pulled into the driveway of his residence and pointed a firearm at him and verbally threatened him.

Patton was not at the scene when officers arrived and a warrant was issued for his arrest which prompted his arrest during his court hearing the very next day.

Chapman later gave sworn testimony in a hearing on the aggravated assault. However, Chapman later admitted “to making a false report to officers in reference to the aggravated assault,” according to Crandall Police Department Chief Dean Winters.

Chapman was then arrested and charged with aggravated perjury, a third-degree felony, on May 20, 2014, and booked into the Kaufman County Jail on a $10,000 bond which he posted in the form of a surety bond the next day and was released.

Originally, 422nd District Court Judge B Michael Chitty ruled Patton's original intoxicated manslaughter bond insufficient and set a new bond amount at $100,000. Patton was also given a $175,000 bond on the aggravated assault charge. After Chapman recanted his story, Patton's original bond for intoxicated manslaughter was reinstated and he was released from the Kaufman County Jail on May 20, 2014.

Patton now awaits trial for intoxicated manslaughter with a vehicle with a trial date set for August 4, 2014.

Kaufman County court records do not indicate a trial date for Chapman at the time of reporting.
